1. Scope
(1) These General Terms and Conditions ("Terms") apply to all orders placed by consumers and businesses through the online shop at nvtssolutions.de with NVTS Solutions, Boelckestrasse 4A, 12101 Berlin, Germany ("we", "us", "seller").
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB).
2. Conclusion of the contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the "Pay now" / "Complete order" button, you submit a binding order for the goods in your cart. We confirm receipt of your order by email immediately after submission. This confirmation does not yet constitute acceptance of the contract.
(3) The contract is concluded when we accept your order with a separate email (shipping confirmation) or dispatch the goods to you.
3. Contract language and storage
The contract languages are English and German. We store the contract text and send you the order details and these Terms by email.
4. Prices and shipping costs
(1) All prices are final prices and include statutory VAT.
(2) Shipping costs may apply in addition to the stated prices. These are clearly shown before you complete your order. For details, see our Shipping Policy.
5. Payment
The available payment methods are shown during checkout and described on our Payment Methods page.
6. Delivery
We deliver to Germany and all member states of the European Union. The estimated delivery time is shown during checkout.
7. Retention of title
The goods remain our property until full payment has been received.
8. Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found on our Right of Withdrawal page.
9. Warranty
The statutory warranty rights apply. The limitation period for claims for defects in new goods is two years from delivery.
10. Liability
We are liable without limitation for intent and gross negligence and in accordance with the German Product Liability Act. For slight negligence, we are only liable for breaches of essential contractual obligations and for damages resulting from injury to life, body or health.
11. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not remove the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.
